DSTRCT-04 TERMS AND CONDITIONS

Please carefully review and agree to the following terms and conditions before signing up with DSTRCT-04.

INTRODUCTION: By signing up with DSTRCT-04, you acknowledge and agree to abide by these terms and conditions, which govern your membership and participation in DSTRCT-04 training sessions.

COOLING-OFF PERIOD: DSTRCT-04 provides a cooling-off period, allowing you to cancel your membership within 7 days of purchase. The 7-day period commences after your first session and ends 7 days thereafter. Any applicable fees during this period will be clearly outlined at the time of cancellation.

MINIMUM AGE: You confirm that you are over the age of 16. If you are under 18 years old, you must have signed permission from a legal guardian to join DSTRCT-04.

HEALTH AND FITNESS: By participating in DSTRCT-04 training sessions, you affirm that you have no physical or medical restrictions that would hinder your participation. You acknowledge that participation is at your own risk, and you release DSTRCT-04, its staff, and agents from any liability for injuries or damages incurred during classes or while on the premises. You understand that trainers are not liable for any injuries sustained during these sessions.

MEMBERSHIP PAYMENTS: Membership fees are due in full and in advance. Payment frequency will depend on your selected membership option, either weekly or fortnightly.

CLIENT RESPONSIBILITIES: You are responsible for ensuring that your account has sufficient funds to process direct debits on the designated payment day. Additionally, you agree to promptly inform us of any changes to your accounts, such as new accounts or updates to your credit card details.

PAYMENT FAILURE: In the event of a failed payment, DSTRCT-04 reserves the right to suspend your access to classes until the outstanding payment is recovered and fully paid off. Your nominated account will continue to be charged until all payments are up to date and settled in full. If a third party is the nominated account holder, they will be held liable for any overdue fees. Missed or failed payments will be communicated to you via phone or email. You, and only you, will be responsible for any overdue fees incurred. If a member's recurring payment fails on the first attempt, we will attempt to take the payment three more times over the coming days. This applies to both card and direct debit payments. After three failed attempts, an additional one-off $15 fee may be charged.

CHANGES TO THE AGREEMENT: DSTRCT-04 may occasionally add, modify, or remove terms and conditions to keep pace with the evolving industry. These changes may encompass adjustments to operating hours, membership fees, or temporary closures for facility improvements. You will be notified of any changes but DSTRCT-04 has the right to do so. 

FEE INCREASE POLICY: DSTRCT-04 reserves the right to increase membership fees only after the agreed-upon contract period has elapsed. You will be notified via email at least 28 days in advance of any fee adjustments. Please note that DSTRCT-04 Foundation members' prices will not increase unless the member cancels.

MEMBERSHIP HOLDS: 

  • Members can place their membership on hold for a minimum of 2 weeks and a maximum of 4 weeks.

  • You can only take out 2 hold periods a year. 

  • A minimum of 1 week's notice is required to initiate a membership hold.

  • There is a $20 administrative fee for each hold.

  • For contracted memberships, the hold will extend the membership cycle.

  • Holds cannot be backdated.

  • Holds for medical reasons are exempt from the fee if evidence is provided.

  • Pro-rata suspensions outside normal billing cycles are not allowed.

  • To initiate a hold, please email us with the subject line "Membership Hold Request" for faster processing.

MEMBERSHIP CANCELLATION:

  • Notice: A minimum of 2 weeks' prior notice and completion of the cancellation form are required to initiate a cancellation.

  • Minimum Term Memberships:

    • Outside of term: 2 weeks' notice from the date of completing the cancellation form.

    • Within term: 2 weeks' notice plus a cancellation fee of 50% of the remaining contract value.

  • "No Ties" Memberships: Can be cancelled at any time with $0 cancellation fee, provided a minimum of 2 weeks' notice is given.

  • Medical Exemptions: No fee for cancellations due to injury preventing training for the remainder of the contract (doctor's certificate required).

  • Rejoining: A joining fee will be applicable when rejoining DSTRCT-04, and a new membership at the current price point will need to be signed up for.

  • Cancellation requests must be submitted via email to receive the necessary form for finalising your cancellation

Referral Program: Refer a friend who joins any DSTRCT membership, and you’ll receive one week free on your current plan once they sign up and complete the online form with your name as their referrer. Only valid for new sign-ups; non-transferable. DSTRCT may modify or end the program at any time.

Discount Code

  • Valid only for recurring memberships, not one-time purchases or drop-ins.

  • Must be applied at sign-up; not valid for existing memberships or renewals.

  • Non-transferable, non-refundable, and cannot be exchanged for cash.

LATE CANCELLATION AND NO SHOW

  • A $10 charge may be applied to the individual's account. This charge will be processed within 7 days of the relevant Late Cancellation or No Show.

  • Definitions:

    • Late Cancellation: Cancellation made less than 8 hours before the start of the relevant class. 

    • No Show: When an individual does not show up to a class they booked into.

    • Late Arrivals: Due to the nature of our classes, late arrivals cannot be accommodated as they cause disruption to the rest of the members.

USE OF YOUR IMAGE: By agreeing to these terms and conditions, you grant DSTRCT-04 permission to capture videos or photos during sessions for promotional purposes. You may opt out of image usage by notifying us in writing. 

DIGITAL COMMUNICATION CONSENT: By providing your contact information, you consent to DSTRCT-04 communicating with you via email, SMS, or other digital means regarding updates, promotions, or important information related to your membership.

COMMUNICATION: For any inquiries or requests, we recommend contacting us via email. Rest assured that all client requests will be responded to within standard business hours, Monday to Friday, from 9 am to 5 pm.
